1. How brand partnerships work
Tailgate Rivals is an invite-only site. Approved brands get a partner profile and a dashboard where they can submit links and video files. We decide what to post, when, and how it is clipped, captioned and credited. Submitting something does not guarantee we will post it.
Files you upload are kept in secure temporary storage so our team can download and edit them, and are deleted automatically after 30 days. Anything we post stays under the license in section 3 until it is removed.
2. You keep your brand
Your company name, logos, trademarks and product images stay yours. Nothing in these terms transfers any ownership to us, and we do not claim any right to use your brand beyond what is stated here.
3. The license you give us
You give Tailgate Rivals a non-exclusive, worldwide, royalty-free license to host, display, embed, share, clip, crop, caption and reformat the content and brand assets you submit, and to show your name, logo and product images on your partner profile and next to content we post, to run and promote the site and our channels (including our YouTube, Instagram, TikTok, Facebook and X accounts, email and ads for the site).
We will not sell your assets to anyone else, and we will only use your logo and marks as you supplied them. We may let service providers that run the site for us handle your content, only for that purpose.
The license lasts while your content or profile is on the site. When it is removed (section 9), we stop using it, except that copies we cannot reasonably reach, such as posts already shared on other platforms or search engine caches, may remain until they expire or you ask us to take them down.
4. What you promise about your content
Every time you submit content or brand assets you confirm that:
- You own them or have all permissions needed to give us the license above, including for music, footage, talent and any third-party trademarks.
- Anyone who clearly appears in your content has agreed to be filmed, and you have the consent of a parent or guardian for anyone under 18.
- Everything you say about your products is true and can be backed up, and your content follows the advertising and labeling rules that apply to you.
- It is not unlawful, hateful, harassing, defamatory or misleading, and it does not show or encourage dangerous behavior.
5. Alcohol, giveaways and regulated products
If your brand sells alcohol, you must follow the laws and industry codes that apply to alcohol marketing, including age rules and responsible-drinking messaging. We may add age or responsibility messaging to content and may decline content that does not meet those standards.
If you run a contest, giveaway or promotion that appears on the site, you are responsible for its official rules and for complying with the laws that apply to it.
6. Sponsored content and disclosure
Content that is paid for, or that a brand gives value for, must be clearly disclosed. We add disclosure such as #ad or "paid partnership" when it applies. If you are working with influencers or other creators on content you submit, you are responsible for making sure they disclose correctly, following the U.S. Federal Trade Commission's endorsement guidelines.
A brand showing on Tailgate Rivals does not mean we endorse the brand's products, and we make no promises about sales or results.
7. Paid partnerships
Joining as a brand is free. Any paid placement, sponsorship or other commercial arrangement is agreed in a separate written agreement, and where it differs from these terms, the separate agreement controls for that arrangement. Without one, no payment is owed by either side, and these terms do not create any exclusivity.
8. Our right to edit, decline and pause
We may edit, shorten, caption, decline, unpublish or remove any content, and we may pause or close any partner account, at any time and for any reason, including if we believe these terms were broken. While an account is paused, its profile page is hidden and new submissions are blocked.
9. Removing your content or profile
You can ask us to remove any of your content, or your profile, or to close your account, at any time by emailing the address at the bottom of this page. We take it down from the site as soon as we reasonably can, usually within five business days, and stop using it from then on.
10. Copyright and trademark claims
If you believe anything on the site infringes your rights, email us at the address below with a link to the page and what is yours. We review every report and remove content when it is justified.
11. Privacy
How we handle information about your company's contacts and visitors to the site is described in our Privacy Policy. Your public partner profile shows only the details you put on it.
12. Responsibility
The site and your dashboard are provided as they are, and we do not promise they will always be available or error-free. To the fullest extent the law allows, Tailgate Rivals is not liable for indirect or consequential losses, or for lost sales, revenue or opportunities, arising from your use of the program.
You are responsible for claims that arise because your content or products broke these terms or someone else's rights, and you agree to cover our reasonable costs if a third party brings such a claim against us.
13. Changes to these terms
If we change these terms, we publish a new version with a new effective date and ask you to accept it the next time you sign in. Earlier versions are kept so you can always see what you agreed to. Until you accept a new version, you cannot use your dashboard.
